Terms and conditions for the purchase of tickets

1. These Terms

1.1 These are the terms on which we sell tickets to you and on which you attend events organised by us.

1.2 Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we sell tickets to you, how we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

1.3 These terms shall apply equally to any persons you have purchased tickets for, and you should therefore bring these terms to their attention before placing an order.

2. Our Details and Communications

2.1 We are Comics Salopia CIC a community interest company registered in England and Wales. Our company registration number is 11625444 and our registered office is at Chapter House North Abbey Lawn, Abbey Foregate, Shrewsbury, Shropshire SY2 5DE.

2.3 If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order. It is your responsibility to inform us of any changes to your contact information which occur during the contract period.

3. Contract

3.1 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. Please note that no order for tickets will be accepted until we have received full payment for the cost of the tickets plus any third-party booking charges and, where applicable, postage and VAT.

3.2 If we are unable to accept your order, we will inform you of this in writing and will not charge you for the tickets. This might be because:

3.2.1 the relevant event is sold out or has been cancelled; or
3.2.2 you have ordered more tickets than the maximum allowed, as indicated during the booking process.
3.3 We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

4. Changes to Order

4.1 If you wish to make a change to the tickets you have ordered please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the tickets and anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

4.2 We may make minor changes to the tickets and events in a number of circumstances provided that they do not materially affect your experience as a whole including, for example:

4.2.1 to reflect changes in relevant laws and regulatory requirements, including, for example, fire safety regulations which may result in us being required to change locations or alter venues;
4.2.2 to implement sensible measures to protect your health and safety, for example to address security threats; and
4.2.3 to accommodate minor changes to guests, locations and times and dates of events.

4.3 Any changes to the tickets or events will be notified to you on our website and social media channels. Please check these regularly in the lead up to, and during, the events.

4.4 In circumstances where we are required to cancel an event, and such event is not rescheduled or rearranged, we will refund you the price of the ticket in accordance with clause 5.4

5. Price and Payment

5.1 The prices for the tickets are set out on our website (in Pound Sterling (£)) and will be confirmed to you as part of the booking process. Any additional costs, such third-party booking charges, postage and VAT will also be confirmed to you as part of the booking process..

5.2 You will be required to pay for the tickets at the time your order is placed. Please note that we only accept payment through our Worldpay platform which accepts the following card types:

5.2.1 Maestro Domestic;
5.2.2 Visa Debit;
5.2.3 Visa Credit;
5.2.4 Visa (Corporate and Commercial);
5.2.5 Debit Mastercard;
5.2.6 Mastercard Credit;
5.2.7 Mastercard Signia;
5.2.8 Mastercard World; and
5.2.9 Matercard (Corporate and Commercial).

5.3 It is always possible that, despite our best efforts, some of the tickets we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the ticket’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the ticket’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and cancel any tickets already provided to you.

5.4 If required under these terms, we will refund you the price you paid for the tickets using the same method you used for payment.

5.5 If you have selected to receive electronic tickets (known as e-tickets) these will be dispatched to you upon acceptance of your order to the email address that you have provided to us.

5.6 If you have selected to receive standard (physical) tickets these will be available for collection from a designated area which we will notify to you on or before the date of the event. Please note that you must bring proof of your order when collecting your physical tickets.

5.7 Please note that we are under no obligation to issue duplicate tickets in the event your tickets are lost or stolen. In such circumstances, we have full and final unrestricted discretion as to whether or not to issue a replacement ticket to you.

5.8 Tickets which are resold or transferred (other than to persons who you have purchased tickets for in good faith (including, for example, friends or family who will attend the events with you)) for any reason by anyone other than us, or an agent authorised by us, will become voidable and the holder may be refused entry

6. Access to Venues and/or Events

6.1 We reserve the right to refuse your admission to an event and/or venue at all times. We shall only exercise such right where it is reasonable to do so, including, for example, in circumstances where we are aiming to protect your health and safety or security..

6.2 Please note that no refund will be given to customers who are refused entry or ejected from a venue on account of late arrival, being or appearing to be under age, declining to be searched, abusive, threatening, drunken or committing other anti-social behaviour (including smoking in no smoking areas), carrying offensive weapons or illegal substances, or making unauthorised audio, video or photographic recordings

6.3 Certain areas of the events and/or venues may be age restricted. Please ensure that you have read all the information that applies to any restrictive area of the event and/or venue when you arrive at the venue and that you are carrying proof of age if applicable. You acknowledge and agree that you will purchase your tickets based on this knowledge.

7. Photography and Recordings

7.1 We encourage the taking of photographs, and no special permission is required from us if you wish to bring a camera to the event. However, to ensure the enjoyment of other customers attending the events please note that you will be required to comply with the following rules:

7.1.1 photography is permitted in all public areas of the events unless signs or staff indicate otherwise;
7.1.2 permission must be sought from the subject of a photograph before taking the photo save for organised activities on stages, exhibitor stands, and signings. You must also allow the subject to see a copy of the photograph taken and, if requested, delete it. You must also allow the subject to see a copy of the photograph taken and, if requested, delete it;
7.1.3 you must not take or attempt to take photos deliberately aimed at compromising the common decency or the dignity of the subject, including, for example, contriving the camera’s position to shoot up a skirt or kilt;
7.1.4 any equipment used must be held by you. Free standing equipment or additional equipment held by other people (including, for example, lights and flashes) is not permitted, unless part of a booked trading or exhibiting space;
7.1.5 you must not use power sockets unless you have obtained the permission of the relevant person in charge of the relevant event venue;
7.1.6 photographs taken within the venues may only be sold to press outlets (unless taken as part of a booked trading or exhibition space). If you wish to sell photography services to the general public or the subjects of the photographs without a booked trading or exhibition space, a £500 fee will be charged for commercial photography.

7.2 You must not take any video recordings without our prior written permission.

8. Guest Availability

Please note that all guest appearances are subject to their own work and personal commitments and we cannot therefore guarantee their attendance at any scheduled event and/or venue.

9. Limitation and Exclusion of Liability

9.1 We do not limit or exclude liability for anything which cannot be legally limited or excluded, including, but not limited to, death or personal injury caused by negligence or fraud or fraudulent misrepresentation.

9.2 Subject to clause 9.1:

9.2.1 our total liability to you (whether in contract, tort (including negligence), breach of statutory duty or otherwise) arising out of or connection with your purchase of tickets or your attendance at any events shall not exceed the price you have paid for the tickets;
9.2.2 we will not be liable to you in any way for any indirect or consequential losses suffered or costs incurred by you. This includes for example, but is not limited to, wasted expenditure such as travel and accommodation costs; and
9.2.3 we shall not be responsible for any loss, damage or injury to any personal property howsoever caused.

9.3 In all arrangements involving third parties, such as any orders placed through a third-party booking website or payments authorised via a third-party platform, we act only as your agent only and we shall have no liability of any kind whatsoever under or in connection with or arising from such an arrangement with a third party. Although we will use our reasonable efforts to help you, you shall be ultimately responsible for liaising with any relevant third party in the event there is a problem.

11. Delays Outside of Our Control

If we become aware of any event which might result in us being unable to supply you with the tickets or hold an event on the advertised date or time, then we will notify you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Such notification will be issued on our website and social media channels, so please regularly check these in the lead up to, and during, the events. Provided that we do this, we will not be liable for delays caused by the event outside of our control.

11. No Cancellation

Please note that you do not have the right to cancel your order or the contract pursuant to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 as the subject matter of the contract concerns the provision of services related to leisure activities on specific dates.

12. Privacy

By placing an order, you consent to the collection, use and retention of your personal information in accordance with our Customer Privacy Notice, a copy of which can be found at here.

13. Use of Our Website

Please note that your use of our website, including the placing of orders, is subject to our Website Terms and Conditions, a copy of which can be found at here.

14. Invalidity

Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

15. Transferability

15.1 You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

15.2 We may transfer our rights and obligations under these terms to another person at any time without your consent.

16. Governing Law

These terms are governed by English law and you can bring legal proceedings in respect of the tickets in the English courts. If you live in Scotland you can bring legal proceedings in respect of the tickets in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the tickets in either the Northern Irish or the English courts.
